Terms of Service

Welcome to Community. These Terms of Service ("Terms") govern your access to and use of the Community platform, including our website, mobile application, and related services (collectively, the "Platform"). By accessing or using the Platform, you agree to be bound by these Terms.

Community is operated by Community App LLC ("Community," "we," "us," or "our"). If you do not agree to these Terms, you may not use the Platform.

1. Eligibility

You must be at least 18 years of age to create an account or use the Platform. By using Community, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

To access certain features, you must create an account by providing accurate and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us immediately of any unauthorized use of your account.

We reserve the right to suspend or terminate accounts that contain inaccurate information or violate these Terms.

You retain ownership of content you submit to the Platform ("User Content"). By posting User Content, you grant Community a non-exclusive, worldwide, royalty-free, transferable license to use, display, reproduce, modify, and distribute your User Content in connection with operating and providing the Platform.

You represent that you own or have the necessary rights to post your User Content and that it does not infringe on the rights of any third party.

We reserve the right to remove any User Content that violates these Terms or that we find objectionable, at our sole discretion.

The Platform, including its design, features, code, and branding, is owned by Community and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of the Platform without our prior written consent.

The Community name, logo, and all related marks are trademarks of Community App LLC.

Your use of the Platform is also governed by our Privacy Policy, which describes how we collect, use, and share your information. By using the Platform, you consent to our data practices as described in the Privacy Policy.

The Platform may contain links to or integrations with third-party websites, applications, or services. We are not responsible for the content, privacy practices, or availability of these third-party services. Your use of third-party services is at your own risk and subject to their respective terms.

10. Disclaimers

The Platform is provided "as is" and "as available" without warranties of any kind, whether express, implied, or statutory. We disclaim all warranties, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Platform will be uninterrupted, secure, or error-free, or that any defects will be corrected.

11. Limitation of Liability

To the maximum extent permitted by law, Community and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, goodwill, or other intangible losses, arising out of or in connection with your use of the Platform.

Our total liability for any claim arising under these Terms shall not exceed the amount you have paid to Community in the twelve (12) months preceding the claim, or $100, whichever is greater.

12. Indemnification

You agree to indemnify and hold harmless Community, its affiliates, officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising out of your use of the Platform, your User Content, or your violation of these Terms.

13. Dispute Resolution

Any disputes arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration administered in accordance with the rules of the American Arbitration Association. Arbitration shall take place in Austin, Texas.

You agree to resolve disputes on an individual basis and waive any right to participate in a class action lawsuit or class-wide arbitration.

Notwithstanding the foregoing, either party may seek injunctive or equitable relief in any court of competent jurisdiction.

We may suspend or terminate your access to the Platform at any time, with or without cause, and with or without notice. Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination will survive, including but not limited to intellectual property, disclaimers, limitation of liability, and dispute resolution.

You may delete your account at any time through your account settings or by contacting us.

15. Changes to These Terms

We may update these Terms from time to time. When we make material changes, we will notify you by updating the "Last updated" date and, where appropriate, providing additional notice through the Platform or via email. Your continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of Texas, without regard to conflict of law principles.
